Copyright Confusion

I’m sure I’m not alone and am not sure where this post will go, but last week I remember trying to figure out Copyright rules for educators.  I wanted to see about using popular music for students in a MovieMaker project?!?!?  I figured NO WAY, but I tried to look into it.  On Twitter, I did get one response from Tawny Press who sent a link to another website (there are, of course, tons out there).  Tawny also said that she may blog about it in the future because Copyright is such a confusing topic.  I guess I’m just trying to write down my own thoughts and what little I know!

I should be more up-to-date with Creative Commons as well.  Isn’t this the wave of the future?  Am I turning more “OpenSourcie?”  I would feel comfortable sharing anything…(not like I produce all that great of stuff), but if I put something out on the web, I would feel honored if someone used it.

As for using popular music, I still don’t know about this 30-second rule for music being ok.  Even though, according to this brochure, it seemed ok in education…this is according to Linworth Publishing, Inc.

It is actually brought up that for music, if the students “instigate” the performance themselves as long as it is legitimately purchased.  This threw me for a loop and ended up causing me to make a phone call to Arista Records and their Liscencing department down at RCA.  I brought up using a country song (of course), and the lady I talked to, Emily, was ready to send me down to a gentleman in Nashville.  Emily said that as long as it’s not going to be published on the web, or to promote something for sale, that it should be ok.  We talked about it just being used for student use.

Well, this is what I have, not even sure where to go from here, but I need to learn more about all of this.  Copyright for me has been the ”Elephant in the room” that I’ve tried to avoid, but no more.  Help if you can!
